House Rules Agreement
This House Rules Agreement ("Agreement") is entered into between the undersigned guest ("Guest") and the property owner ("Owner") for the property located at 205 N Miller St., Rockaway Beach, OR 97136, hereinafter referred to as "the Property".
1. Noise Disturbances: Guest agrees to adhere to all local noise ordinances and acknowledges that over-occupancy and house parties are strictly prohibited. Any noise complaints or violations will result in immediate eviction without refund.
2. Age Requirement/Occupancy: Guest confirms that all guests' ages have been disclosed and that occupancy will not exceed the maximum stated in the confirmation email. Events or gatherings must be disclosed before booking, and all adult group members must be 25 years or older.
3. No Inconvenience Refund: Guest acknowledges that the Property is located in a dynamic area and agrees that occasional inconveniences, such as nearby construction, may arise. While the Owner will strive to resolve issues promptly, no refunds will be issued for circumstances beyond the Owner's control.
4. Reservation Details: Check-in time is 4:00 PM, and checkout time is 10:00 AM. Specific instructions for accessing the Property will be emailed to Guest the day before arrival. All payments are managed through Airbnb as per the booking listing.
5. Property Maintenance: Guest agrees to reset smoke detectors upon arrival and promptly report any issues within 24 hours. Owner reserves the right to inspect the Property for maintenance purposes.
6. Occupancy and Safety: Guest acknowledges and agrees to abide by the maximum occupancy stated in the confirmation email. Guest assumes responsibility for supervising children and agrees to take precautions to prevent accidents or injuries.
7. Usage Guidelines: Guest agrees not to engage in any unlawful activities or cause disturbances on the Property. Parties are strictly prohibited.
8. Pet Policy: Guest acknowledges that pets are not allowed on the Property without prior written consent from the Owner. Violations will result in immediate removal from the Property.
9. Smoking: Guest agrees that smoking is prohibited inside the Property and on the premises.
10. Personal Property: Guest agrees to assume responsibility for all personal belongings left on the Property. Lost items will be held for 48 hours before disposal.
11. Cancellation Policy: Guest agrees to refer to the listing and confirmation email for the cancellation policy.
12. Subletting: Guest agrees not to sublet or assign the agreement without prior written consent from the Owner.
13. Legal Compliance: Guest agrees to abide by all local, state, and federal laws during their stay at the Property.
14. Indemnification: Guest agrees to indemnify the Owner against any liability incurred during their stay, except in cases of willful gross negligence by the Owner.
15. Governing Law: This Agreement shall be governed by the laws of the State of Oregon, and any legal disputes shall be litigated in Portland.
16. Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings.
